Terms and Conditions: HughesNet Small-Medium Business Solutions

General Terms and Conditions for HughesNet services purchased between July 1, 2008 and January 3, 2011

HughesNet® service is available in the contiguous U.S. with an unobstructed view of the southern sky, is not available in Alaska and Hawaii, and its usage is subject to the Fair Access Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Website, or by the overall performance and configuration of your computer. Stated speeds and uninterrupted use of service are not guaranteed. Actual speeds will likely be lower than speed indicated during peak hours.

Listed speeds are available only through Hughes’ new satellite. The majority of subscribers will have access to these faster speeds. However, approximately 5-8% will not be able to receive these speeds as a result of trees or other obstacles that block the signal from the satellite to the site location. In these cases, Hughes can offer slightly slower Internet access via another satellite with download speeds up to 1.0 Mbps, 1.5 Mbps, and 2.0 Mbps; and upload speeds up to 200 Kbps, 300 Kbps and 500 Kbps for the IA100, IA200, and IA300 service plans, respectively.

Professional installation is required. Monthly service fees apply. Taxes not included.

Service Commitment

HughesNet Service Plans require a minimum service commitment of twenty-four (24) months. If you terminate service prior to the expiration of the commitment, you will owe and your credit or debit card will be charged the Termination Fees as described below.

Early Termination: Credit Card Billing

If you cancel your order before installation, you will not be charged.

If you cancel service within 30 days of activation:

“Business Internet” Plan subscribers (BI100, BI200, BI300, BI400, BI500, BI600, BI700) may return the modem and outdoor transmitter to Hughes for a refund. Once this equipment has been received by Hughes, you will be refunded a total of $200. Hughes will provide instructions on how to de-install and return the equipment. Returned equipment must be in good condition. You will not receive a refund for installation charges or other fees. You are not required to return, and Hughes is not obligated to de-install, the antenna, mount, or any cables. If you elect to have the complete system or the antenna, mount, and any cables professionally de-installed, you will be responsible for all de-installation charges.

If you cancel service after 30 days from the date of activation but before the end of the initial twenty-four- (24-) month commitment:

“Business Internet” Plan subscribers (BI100, BI200, BI300, BI400, BI500, BI600, BI700) will be charged a $400 Service Termination Fee. HughesNet equipment may not be returned for a refund after 30 days.

Early Termination: Invoice Billing

If you cancel your order before installation, you will not be charged.

If you cancel service within 30 days of activation:

“Business Internet” Plan subscribers (BI100, BI200, BI300, BI400, BI500, BI600, BI700) may return the modem and outdoor transmitter to Hughes within 60 days of the date of termination for a refund (assuming these items, as well as the applicable installation charges, have been paid for in full). Once this equipment has been received by Hughes, you will be refunded a total of $200. You will not receive a refund for installation charges or other fees. Hughes will provide instructions on how to de-install and return the equipment. Returned equipment must be in good condition. You are not required to return, and Hughes is not obligated to de-install, the antenna, mount, or any cables. If you elect to have the complete system or the antenna, mount, and any cables professionally de-installed, you will be responsible for all de-installation charges.

If you cancel after 30 days from the date of activation but before the end of the initial twenty-four- (24-) month commitment:

“Business Internet” Plan subscribers (BI100, BI200, BI300, BI400, BI500, BI600, BI700) will be required to pay for the HughesNet equipment and installation in full, plus a $400 Service Termination Fee. In addition, any amounts outstanding for equipment and installation must be paid in full.

Equipment may not be returned for a refund after 30 days.

Online Ordering

YOU AGREE AND ACCEPT THAT HUGHES NETWORK SYSTEMS, LLC (HUGHES) IS AUTHORIZED TO USE YOUR CREDIT OR DEBIT CARD FOR THE PURPOSE OF: (1) CHARGING YOU FOR THE UPFRONT FEES REQUIRED TO RECEIVE HUGHESNET SERVICE, INCLUDING PAYMENT FOR EQUIPMENT AND INSTALLATION; (2) CREATING A HUGHES/HUGHESNET CUSTOMER ACCOUNT; (3) CHARGING YOU FOR YOUR MONTHLY SERVICE FEES AND ANY EQUIPMENT OR INSTALLATION FEES THAT MAY APPLY; AND (4) CHARGING ANY APPLICABLE EARLY TERMINATION FEES.

Networking

“Business Internet” Plan subscribers (IA100, IA150, IA200, IA300, IA400): For these service plans, networking equipment is not included with your HughesNet system. For network setup, support, and configuration, contact your network hardware manufacturer and/or operating system software developer. (Hughes is not responsible for network configuration or management).

Please note that all computers on a network will be sharing a single connection. Simultaneous use of high-bandwidth applications by multiple users may result in degradation of download and surfing speeds, and are subject to the Fair Access Policy.
